Terms of Service

These Terms of Service ("Terms") govern your access to and use of ActRegistry ("the Platform"), operated by ActRegistry ("we," "our," or "us"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using ActRegistry, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. If you are using the Platform on behalf of an organization (such as a band, venue, or booking agency), you represent that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use the Platform.

2. Account Terms

You are responsible for maintaining the security of your account and password. ActRegistry cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You must provide accurate and complete information when creating your account. Artist profiles must accurately represent the act being registered. Venue profiles must reflect the actual venue and its legitimate capacity and operational details.

You may not use the Platform for any illegal or unauthorized purpose. You must not, in the use of the Platform, violate any laws in your jurisdiction.

We reserve the right to suspend or terminate accounts that provide false information, manipulate draw data or ratings, or violate these Terms.

3. Booking Terms

ActRegistry facilitates connections between artists and venues but is not a party to the booking agreement itself. When an artist and a venue confirm a booking through the Platform, they enter into a direct agreement with each other.

Both parties are expected to honor confirmed bookings. Details including date, time, compensation, technical requirements, and any special conditions should be clearly agreed upon through the Platform before confirmation.

ActRegistry provides standardized booking templates to help ensure clarity, but both parties are responsible for reviewing and agreeing to the specific terms of each engagement.

We are not responsible for the quality of performances, venue conditions, or any disputes arising between artists and venues. We encourage parties to resolve disputes directly, though we offer a mediation process for bookings made through the Platform.

4. Ratings & Reviews

After each completed booking, both the artist and the venue may leave a rating and review. Ratings are a core part of the ActRegistry trust system and must be honest, fair, and based on the actual experience.

You may not offer incentives, threaten, or otherwise attempt to influence another party's review. You may not review your own act or venue using a separate account.

Verified draw data is generated through our proprietary verification system and cannot be manually edited by users. If you believe your draw data is inaccurate, you may submit a dispute through your account dashboard.

We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms.

5. Payments

ActRegistry may facilitate payment processing between artists and venues through our integrated payment system. When payments are processed through the Platform, we charge a service fee as outlined on our pricing page.

Payments processed through the Platform are held in escrow and released to the artist within 48 hours of the completed performance, unless a dispute is filed.

Parties may choose to handle payment arrangements outside of the Platform, in which case ActRegistry assumes no responsibility for payment disputes.

All fees and pricing are listed in US dollars unless otherwise stated. You are responsible for any applicable taxes related to your use of the Platform.

6. Cancellation Policy

Cancellations must be communicated through the Platform as soon as possible. Our standard cancellation policy is as follows:

  • More than 14 days before the event: Full refund, no penalty to either party's reputation score.
  • 7–14 days before the event: 50% of the booking fee is retained. A minor impact on the cancelling party's reliability score.
  • Less than 7 days before the event: Full booking fee is retained. Significant impact on the cancelling party's reliability score.
  • No-shows: Full booking fee is forfeited, and the incident is flagged on the cancelling party's profile. Repeated no-shows may result in account suspension.

Exceptions may be granted for documented emergencies or force majeure events at ActRegistry's discretion.

7. Limitation of Liability

ActRegistry is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Platform.

To the fullest extent permitted by law, ActRegistry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to ActRegistry in the twelve months preceding the claim.

8. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on the Platform at least 30 days before the changes take effect.

Your continued use of ActRegistry after updated Terms take effect constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Platform and close your account.

We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
